1. Acceptance of Terms

Welcome to WildThyme! WildThyme Inc. ("WildThyme," "we," "us," or "our") provides lead generation and marketing automation services (collectively, "Services") to help businesses improve their customer acquisition through digital advertising platforms. These Terms of Service ("Terms") are entered into by and between WildThyme and the individual or entity accepting these Terms ("Customer," "you," or "your").

By using or accessing the Services, you are agreeing to these Terms and our Privacy Policy. If you do not agree to these Terms and our Privacy Policy, please do not access or use the Services.

2. Our Services

WildThyme provides AI-powered lead generation services that help businesses identify, target, and acquire qualified leads through various digital advertising platforms. Our services include:

Multi-platform advertising campaign management
AI-powered audience targeting and optimization
Lead qualification and scoring
Automated follow-up sequences
Performance analytics and reporting

You pay only for qualified leads that respond to your campaigns, as defined in our pricing structure.

3. Your Account

To use the Services, you must provide us with accurate, complete, and up-to-date information for your account. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account.

You agree to accept responsibility for all activities that occur under your account or password. You must notify us immediately of any breach of security or unauthorized use of your account.

4. Payment Terms

Our pricing is based on a pay-per-qualified-lead model. You will be charged only for leads that meet our qualification criteria and respond to your campaigns. Pricing ranges from $30 to $100 per qualified lead, depending on your selected plan and targeting parameters.

Payment is due within 30 days of invoice date. Late payments may result in service suspension. All fees are non-refundable except as expressly stated in these Terms or required by law.

We reserve the right to change our pricing with 30 days' notice to existing customers.

5. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

In any way that violates applicable federal, state, local, or international law or regulation
To engage in any form of spam, unsolicited advertising, or harassment
To promote illegal activities, violence, or discrimination
To collect or harvest personal information without consent
To interfere with or disrupt the Services or servers

6. Data and Privacy

We take data privacy seriously. Our collection, use, and protection of your personal information is governed by our Privacy Policy. By using our Services, you consent to the collection and use of information as described in our Privacy Policy.

You retain ownership of your customer data and lead information. We will not share, sell, or distribute your data to third parties without your explicit consent, except as required by law.

7. Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of WildThyme and its licensors. The Services are protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

8. Limitation of Liability

In no event shall WildThyme, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Services.

Our total liability to you for all claims arising from or relating to the Services shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Services will cease immediately.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
